1. COLLECTION OF PERSONAL DATA

LOVE PH will collect personal data from you directly, such as (a) when you visit the LOVE PH platform, (b) when you create an account on the LOVE PH platform, (c) when you use, book, or purchase LOVE PH services, and (d) when you collaborate with LOVE PH for the provision of its services (as a merchant, agent, and/or affiliate) (collectively, the “Operators”). The term “Operator” refers to individuals and parties that LOVE PH partners with to provide its services to you, such as travel agents, tour operators, activity providers, restaurants, shops, airlines, transportation companies, railway companies, cruise companies, amusement parks, telecommunication network operators, hotels, and car rental companies.

LOVE PH may also collect personal data about you from third parties, including the Operators as described above.

Others’ Data

If you provide us with personal data about other individuals (e.g., when you make reservations or bookings for others through the LOVE PH platform), you must obtain the necessary consent from those individuals and ensure they are informed of, understand, and accept this Privacy Policy before you share their personal data with LOVE PH.

Children’s Data

We only process personal data of children when such data is provided by a parent or legal guardian. For example, LOVE PH may process a child’s personal data if it is submitted as part of a reservation, rental, booking, or purchase of LOVE PH services.

2. TYPES OF PERSONAL DATA

Depending on how you access and use the LOVE PH platform, LOVE PH will collect and process some or all of the following personal data:

(a)  Identification information and contact details

Information such as your first name and surname, date of birth, email address, phone number, postal address, country and region of residence, and any other details directly related to identifying and contacting you. Such information may be collected when you create a LOVE PH user account on the LOVE PH platform or when you sign up as an Operator to offer LOVE PH services.

(b)  Booking information

Information such as your passport details (including passport number and expiry date), nationality, government-issued identifiers, frequent flyer membership number, credits earned upon purchase/booking of LOVE PH services (“LOVE PH Credits”), certification/qualifications (e.g., diving level, driver’s license), necessary billing and payment details such as credit card information, billing address, bank account numbers, and insurance details—anything essential to completing a LOVE PH booking.

(c)  Travel preferences and itinerary details

Details including your chosen destinations, flight schedules, accommodation, activities, prior bookings and purchases, and other travel-related preferences.

(d)  Health information (in exceptional cases only)

Information such as medical certificates, doctors’ notes, or any health-related documentation relevant to your participation in booked LOVE PH services.

(e)  Uploaded content

Photos (including facial images), videos, recordings, and comments that you upload to the LOVE PH platform.

(f)  Communications

Details of your communication with LOVE PH or with Operators, whether via the LOVE PH platform, email, instant messaging, social media, or other channels.

(g)  Survey responses

Feedback and responses to surveys related to LOVE PH services.

(h)  Device and technical information

Data such as IP address, device specifications, device type, unique identifiers, MAC address, clickstream data, timestamps, cookie IDs (and other tracking technologies), visited pages, and browsing activity.

(i)  Location data

Information inferred from your IP address, telecom operator/carrier, SIM region, network, and other geolocation data. You may disable location sharing in your device settings.

When you use your mobile device to access the LOVE PH platform, we may collect location data (if permitted via your device settings) or images with embedded location information. This data may be used to enhance your experience by suggesting nearby services or offering personalized content. You may adjust your device’s privacy settings to disable location sharing, though some features of the LOVE PH platform may not function fully as a result. LOVE PH also offers experimental AI services, such as the LOVE PH AI chatbot (“LOVE PH AI Tools”), powered by third-party generative AI technologies. We may collect personal data that you submit as input or feedback while using these AI Tools.

Please avoid submitting any confidential or sensitive information when using LOVE PH AI Tools.

By using LOVE PH AI Tools, you acknowledge and agree that:

• Third-party AI providers (not owned or controlled by LOVE PH) support these tools, and their usage is subject to their terms and privacy policies.
• Any data you provide may also be collected and processed by those providers, such as OpenAI, under their own policies.
• LOVE PH may use your inputs to improve and refine LOVE PH AI

3.  USE OF PERSONAL DATA

LOVE PH will process your personal data for the following purposes:

(a)  To manage your user account

To facilitate the creation of your user account on the LOVE PH platform, manage its settings, and amend any related information.

(b)  To provide LOVE PH services to you

To fulfill your reservations, rentals, or bookings; send confirmations and reminders; verify your eligibility for high-risk activities (e.g., diving, paragliding, skydiving); inform you of booking modifications; provide relevant insurance options; assist in insurance claims; and coordinate with insurance providers on your behalf.

(c)  To verify identity

To verify your identity in connection with the LOVE PH services you have booked or purchased.

(d)  For marketing purposes

To provide you with marketing communications from LOVE PH, as described in more detail in Section 5 of this policy.

(e)  For feedback and market research

To contact you for feedback or survey participation related to your use of the LOVE PH platform and services.

(f)  To provide customer support

To respond to your inquiries, resolve issues, and offer any necessary support related to your use of LOVE PH services.

(g)  To improve the LOVE PH platform and services

To enhance our services and ensure that the LOVE PH platform operates properly and aligns with your preferences and needs.

(h)  To comply with legal obligations and for administrative purposes

To verify and process payments, issue invoices, detect and prevent fraud, abusive bookings, money laundering, and other unlawful activities; fulfill auditing, billing, and accounting responsibilities; and to maintain, test, or improve internal systems. Your data may also be used to protect our legal rights or the rights of others.

4.  SHARING OF PERSONAL DATA

LOVE PH will share some of your personal data with third parties, which may be located outside your home country or region, as described below:

(a)  Operators

LOVE PH may share your data with Operators (e.g., tour providers, restaurants, shops, transport companies, cruise lines, amusement parks, hotels, telecom providers, insurance providers, etc.) to enable them to deliver LOVE PH services and complete your bookings.

(b)  LOVE PH group companies

LOVE PH may share your data with affiliated companies within the LOVE PH group to act on our behalf for the purposes stated in Section 3 (e.g., payment processing for bookings).

(c)  Third-party service providers

LOVE PH may engage trusted third-party service providers to perform activities outlined in Section 3. These may include web hosting, cybersecurity, data analytics, payment processing, marketing, customer service, and market research.

(d)  Government and regulatory bodies

LOVE PH may disclose your data to government agencies, regulatory authorities, law enforcement, legal advisers, auditors, and other appropriate bodies to comply with legal obligations or court orders, or to protect our rights and those of others.

(e)  Corporate reorganization
